Hudl U.S. State Specific Privacy Policy

This Hudl U.S. State Specific Privacy Policy supplements the information contained in the Hudl Privacy Policy for residents of the States of California, Virginia, Colorado, Connecticut, Utah, Oregon, Texas and Montana as applicable (“consumer(s)” or “you”).If you are a resident of the States of Virginia, Colorado, Connecticut, Utah, Oregon, Texas, and Montana, the terms “consumer(s)” and “you” only include such residents in their individual (personal) or household capacity (and not in their capacity as part of an organization, including, for example, as representative of a club, team, or organization or as an athlete or coach on a team).

We adopt this notice to comply with disclosures requirements of the following state laws (“State Privacy Laws”):

• The California Consumer Privacy Act of 2018, as amended (“CCPA”)
• The Colorado Privacy Act (“CPA”)
• The Connecticut Personal Data Privacy and Online Monitoring Act ("CTDPA")
• The Utah Consumer Privacy Act ("UCPA")
• The Virginia Consumer Data Protection Act (“VCDPA”)
• The Oregon Consumer Privacy Act (“OCPA”)
• The Texas Data Privacy and Security Act (“TDPSA”)
• The Montana Consumer Data Privacy Act (“MTCDPA”)

Any terms defined in these State Privacy Laws have the same meaning when used in this State Specific Privacy Policy. For this State Specific Privacy Policy and the Hudl Privacy Policy,

• For California consumers, the term “personal information” has the meaning given to it in the CCPA.Personal information does not include publicly available information, as defined in the CCPA.
• For Colorado, Virginia, Connecticut, Utah, Oregon, Texas, and Montana consumers, the term “personal information” means “personal data” as defined in the CPA, VCDPA, CTDPA, UCPA, OCPA, TDPSA, or MTCDPA as applicable. Personal information does not include publicly available information, as defined in the CPA, VCDPA, CTDPA, UCPA, OCPA, TDPSA, or MTCDPA as applicable.

1. For California Consumers Only

This State Specific Privacy Policy does not apply to workforce-related personal information collected from California-based Hudl employees, job applicants, or similar individuals. If you apply for a job with Hudl, you will be provided with our applicant privacy policy. If you are a California-based Hudl employee, you will be provided with our employee privacy policy.

a. Information We Collect

In particular, we collect the following categories of personal information from consumers, and have collected such information within the last twelve (12) months (from the date of this State Specific Privacy Policy), depending on which of our products or services were used by consumers:

• Identifiers - A real name, alias, postal address, unique personal identifier, online identifier, login information for our products and services, phone numbers, IP address, email address, or other similar identifiers.
• Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)) - A name, physical characteristics or description, address, telephone number, limited education and employment information included in your user profile information, credit card number, and debit card number.
• Protected classification characteristics under California or federal law - Information that may reveal your age, gender, race, color, ancestry, religion or creed, national origin, citizenship, marital status, disability, medical condition, and other information, for example if you voluntarily disclose this information as part of your activity on our products or services, if it is entered by you or others on our products or services, or if it can be determined from viewing content available on or captured by our products or services.
• Commercial information - Records of products or services of ours that you purchased, obtained, or considered, or other purchasing or consuming histories or tendencies, including for example your content streaming activity.
• Internet or other similar network activity - Browsing history, viewing history, search history, information on a consumer’s interaction with a website, application, or advertisement, and contents of messages, such as those you can send with Hudl Messaging.
• Geolocation data - Data such as physical location or movements or device location, generalized location data based on your IP address (such as your general jurisdiction to determine language), and precise GPS and positioning information captured when you use a Hudl wearable device.
• Sensory data - Audio, electronic, visual, or similar information, such as photos and videos on our products or services.
• Professional or employment related information - For example, your current position if provided as part of your account profile.
• Non-public education information - This may include education records where provided by our educational organization customers.
• Inferences drawn from your personal information to create a profile reflecting your preferences, characteristics, behavior, attitudes, intelligence, abilities, and aptitude — For example, recommending streaming content to Hudl Fans.
• Sensitive personal information - Whether we collect such information depends on the product or service of ours that you use. Such information may include biometric information, health information, and precise location information.

b. Sharing Personal Information

We may share your personal information by disclosing it to a third party for a business purpose, as provided in the Hudl Privacy Policy.

Please note that Hudl will never use or disclose any sensitive personal information you give us except to provide you with the goods and services you have requested (or where you are an authorized user of a Hudl customer, to provide the Hudl customer with the goods or services requested) or for the limited purposes allowed under the law.

2. Your Rights and Choices under State Privacy Laws

a. Your Rights

The State Privacy Laws provide consumers covered by this State Specific Privacy Policy certain rights regarding your personal information. This section describes those rights and explains how to exercise those rights. You may also have the right to appeal the denial of any of these rights through our existing support process if we deny a data request.

We will not discriminate against you for exercising any of your rights under applicable State Privacy Laws.

Please note that depending upon your data choices, certain products and services of ours may be limited or unavailable.

As a consumer, you have the following rights under the State Privacy Laws:

• Right to Know - You have the right to request that we disclose the specific pieces of personal information we have collected about you (the “right to know”), after we receive and validate your request. This right also includes data portability, which means you have the right to receive a copy of your personal information in a format required by the applicable State Privacy Laws. Follow Exercising Your Rights to Know or Delete below in order to make your request.
• Right to Delete - You have the right to request that we delete your personal information, subject to applicable legal exceptions (the “right to delete”). After we receive and validate your request, we will delete your personal information, as well as direct our service providers to delete your personal information, unless an exception applies. Follow Exercising Your Rights to Know or Delete below in order to make your request.
• Right to Correct (excluding Utah consumers) - You have the right to request that we correct inaccurate personal information that we maintain about you, subject to applicable legal exceptions. You may be able to correct certain information in your account on our products or services as well. If such functionality is not available, you can make a request to correct your personal information by emailing us at support@hudl.com.
• Right to Opt Out of Personal Information Processing for Targeted Advertising and Sales - For more details on how to exercise your rights, see Personal Information Sales or Sharing Opt-Out and Opt-In Rights below.
• Right to Opt Out of Personal Information Processing for Profiling - This right is generally available where profiling (automated decision making) is being used in furtherance of decisions that produce legal or similarly significant effects. This right is not available for Utah or California consumers. You can exercise this right by emailing us at support@hudl.com.
• Right to Limit (or Opt Out of) or Require Consent to Process Sensitive Personal Information
  • California consumers - you have the right to request that we limit sensitive personal information use to specifically permitted purposes. You can exercise this right by emailing us at support@hudl.comp.
  • Colorado, Connecticut, Virginia, Texas, Oregon, and Montana consumers - we must obtain your prior consent in order to process your sensitive personal information.
  • Utah consumers - we must provide you with clear notice and an opportunity to opt out of the processing of your sensitive personal information in order for Hudl to process your sensitive personal information.

The exact scope of these rights may vary by state.

b. Exercising Your Rights to Know or Delete

To exercise your rights to know or delete described above, please submit a request by emailing us at support@hudl.com. Only you, your Authorized Agent (as described below) or someone legally authorized to act on your behalf, such as a parent or legal guardian submitting a request for their child, may make a request to know or delete related to your personal information.

If you are a California, Colorado, Connecticut, Oregon, Texas, or Montana consumer, you may authorize another person or entity to submit an access or deletion request on your behalf (an “Authorized Agent”). As part of our verification process, we will require proof concerning their status as an Authorized Agent. We may also require you to directly confirm with us that you provided such person or business entity with permission to submit the request. An Authorized Agent can submit access and deletion requests by emailing us at support@hudl.com. This option is not available for Utah or Virginia consumers.

Any request to know or delete from you or your Authorized Agent must:

• Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information, or their Authorized Agent, parent or legal guardian, if applicable.
• Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

You do not need to create an account with us to submit a request to know or delete.

c. De-identified Data Disclosure

Hudl may use de-identified data in some instances. Hudl either maintains such data without attempting to re-identify it or treats such data as personal information subject to applicable law.

d. Personal Information Sales and Sharing Opt-Out and Opt-In Rights

Sharing or Targeted Advertising - Hudl may "share" (as defined under the CCPA) your personal information in certain cases or may use your personal information for Targeted Advertising (as defined under State Privacy Laws). For example, if you have a Hudl Fan account, we may disclose information to advertising partners, advertising technology companies, and companies that perform advertising-related services in order to provide you with more relevant advertising tailored to your interests on the Hudl products and services. This information may include identifiers such as your IP address, advertising identifiers, your email address, your internet or other electronic network information such as your interaction with an ad, and geolocation data.

Sales - Hudl may disclose certain information about you for purposes that may be considered a “sale” under State Privacy Laws. For example, where athletes have opted into recruiting on the Hudl platform, Hudl provides your personal information to verified recruiters as described in the Hudl Privacy Policy. Additionally, Hudl may share game video, highlights, and other content on our products or services with customer or third party consent; such sharing may be considered a “sale” under the State Privacy Laws in certain cases. Hudl may also share your personal information with third-party streaming content providers as described in the Hudl Privacy Policy.

California residents - If you are age 16 or older, you have the right to direct us to not "sell" or "share" (as either term is defined in the CCPA) your personal information at any time (the “right to opt-out”). California residents we actually know are under 16 years old (and at least 13 years old) must give us affirmative authorization (the “right to opt-in”) in order for us to sell or share their personal information. California residents we actually know are under 13 years old must have their parent or guardian give us affirmative authorization (the “right to opt-in”) in order for us to sell or share their personal information. California residents who opt-in to personal information sales may opt-out of future sales at any time.

Exercising your rights - To exercise the right to opt-out of the sale or sharing of your personal information or use for targeted advertising under the State Privacy Laws, you or your Authorized Agent (certain states only) may submit a request to us by sending an email to support@hudl.com or visiting the following link: https://www.hudl.com/support/contact. Alternatively, you may submit a request by submitting the following form: Do Not Sell or Share My Personal Information.

However, you may change your mind and opt back in to personal information sales at any time by submitting a request to support@hudl.com.

You do not need to create an account with us to exercise your opt-out rights. We will only use personal information provided in an opt-out request to review and comply with the request.

We will not discriminate against you for exercising any of your rights under the State Privacy Laws.

e. Other California Privacy Rights

California’s “Shine the Light” law (Civil Code Section § 1798.83) permits users of our websites that are California residents (using the websites in their personal or household capacity) to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.
